NOTICE OF RISK
I, the undersigned, do hereby understand, acknowledge and agree that Garden Chapel events, activities and projects have possible inherent risks. These risks include, but are not limited to, sports or game injuries, falls, collisions with other participants or objects, equipment failures, vehicle accidents, etc.
ASSUMPTION OF RISK
Understanding, acknowledging and agreeing to all the risks involved, my minor child or I am voluntarily participating in events, activities or projects of Garden Chapel, and I agree to assume for myself or my minor child, all the risks involved.
RELEASE FROM LIABILITY
In consideration of being allowed to participate in Garden Chapel events, activities and projects, I HEREBY AGREE NOT TO SUE AND TO RELEASE GARDEN CHAPEL, AS WELL AS ITS OFFICERS, AGENTS, EMPLOYEES, AND MEMBERS FROM ANY AND ALL LIABILITY, RELATED TO ANY PAST, PRESENT OR FUTURE INJURY OR OTHERWISE RELATED TO MY OR MY CHILD’S PARTICIPATION OR USE OF THE FACILITIES, REGARDLESS OF ANY NEGLIGENCE, INCLUDING GROSS NEGLIGENCE OR OTHER IMPROPER CONDUCT ON THE PART OF GARDEN CHAPEL, AS WELL AS ITS OFFICERS, AGENTS, EMPLOYEES, AND MEMBERS.
I FURTHER AGREE TO HOLD HARMLESS, INDEMNIFY AND DEFEND GARDEN CHAPEL, AS WELL AS ITS OFFICERS, AGENTS, EMPLOYEES, AND MEMBERS FROM ANY CLAIM RELATED TO MY OR MY CHILD’S PARTICIPATION IN GARDEN CHAPEL EVENTS, ACTIVITIES AND PROJECTS OR THE USE OF THE FACILITY, REGARDLESS OF ANY NEGLIGENCE ON THE PART OF GARDEN CHAPEL, AS WELL AS ITS OFFICERS, AGENTS, EMPLOYEES, AND MEMBERS.
As a participant of Garden Chapel events, activities or projects, I understand and agree that this agreement constitutes a contract and may negate my ability to bring suit or recover damages related to any claim that I may have. I understand that the signature of one parent or guardian binds both parents or guardians in reference to this agreement. I further understand and agree that this agreement is binding not only to myself, but also my heirs, executors, administrators and assigns and I herewith again reaffirm my free and willful intent to execute it.
I agree that all disputes arising under this contract shall be litigated exclusively in the Court of Common Pleas of Dauphin County or in the United States District Court for the Middle District of Pennsylvania. This agreement is governed by the applicable laws of the state of Pennsylvania. If any part of this agreement is determined to be unenforceable, all other parts shall be given full force and effect.
